PCM Guideline on AI and Intellectual Property for the Process Communication Model®

The Process Communication Model® (PCM) is a proprietary methodology protected by intellectual property rights worldwide.
PCM, Process Communication Model®, and related names, logos, materials, and tools are the property of Kahler Communications and/or its authorized entities. This protection extends, among other things, to:
- PCM Concepts, Terminology, and Pedagogical Architecture;
- PCM questionnaires and assessment tools;
- PCM profiles and reports;
- PCM manuals, training materials, slides, videos, and certification content;
- PCM Accreditation and Certification Pathways;
- All confidential, restricted-access, or non-public PCM resources made available to certified professionals, sales partners, partners, or customers.
Use of PCM Content in Artificial Intelligence Systems
Without prior written permission from Kahler Communications, no non-public PCM content may be uploaded, transmitted, copied, processed, or used for prompting, training, fine-tuning, or indexing in public or private generative AI systems, large language models, chatbots, assistants, agents, knowledge bases, or machine learning tools; nor may such content be used for prompts, training, fine-tuning, indexing, retrieval, embedding, or otherwise integrated.
This prohibition applies in particular to:
- PCM manuals and slides;
- Certification and accreditation documents;
- Guides for Moderators;
- Questionnaires, evaluation logic, and evaluation mechanisms;
- PCM profiles and detailed report content;
- Videos, exercises, and in-house teaching materials;
- All confidential content that can be accessed via PCM platforms or professional communities.
Prohibited AI Tools and Identity Fraud
No chatbot, GPT, AI assistant, AI coach, automated evaluation tool, application, or digital service may:
- present themselves as “PCM,” “Process Communication Model,” or “official PCM,” or otherwise imply that they are authorized, sponsored, or supported by Kahler Communications;
- claim to identify or deduce a person’s PCM basis, phase, personality structure, or official PCM profile;
- generate, simulate, or reproduce an official PCM profile or a PCM evaluation result;
- replicate or replace proprietary PCM tools, reports, questionnaires, certification processes, or professional debriefings;
- Use PCM trademarks, terms, or copyrighted materials in a way that causes confusion regarding their origin, authorization, or affiliation.
Any such use requires an express written license from Kahler Communications.
Official PCM Analysis (“PCM Profiles”) and Authorized Use
Only analyses created using official PCM tools and provided by duly authorized PCM experts in accordance with PCM standards may be presented as PCM-based assessments, PCM profiles, or official PCM evaluations.
Artificial intelligence must not be used to replace, simulate, or circumvent the authorized PCM questionnaire, the official profiling process, or the role of certified PCM experts, where such authorization is required.
Protection, Enforcement, and Requests for Removal
Kahler Communications actively protects PCM's intellectual property and may take all appropriate measures against unauthorized use, including:
- contractual enforcement;
- Cease-and-desist letters;
- Complaints regarding trademark and copyright infringements;
- Requests to remove or restrict unauthorized AI assistants, GPTs, datasets, bots, applications, websites, or other infringing materials;
- legal action, if necessary.
Major AI platforms offer reporting procedures for suspected copyright and trademark infringements. OpenAI, for example, maintains dedicated reporting channels for copyright and trademark disputes, as well as more comprehensive mechanisms for reporting content. (OpenAI)
Report of Unauthorized Use of PCM by AI
Anyone who becomes aware of an AI tool, chatbot, GPT, assistant, online service, or dataset that appears to be using PCM's intellectual property without authorization is asked to report it to Kahler Communications, including:
- the name of the tool or service;
- the URL or location on the platform;
- Screenshots or examples of the alleged misuse;
- Any indication that the tool claims to be official, licensed, or PCM-based.
Kahler Communications will review such reports and take appropriate action as necessary.
Our Approach
Kahler Communications recognizes the potential value of artificial intelligence when it is used responsibly, ethically, and lawfully. However, AI must not be used to appropriate, reproduce, dilute, or misrepresent the Process Communication Model® or its protected ecosystem.
Our goal is to uphold the integrity, quality, and reliability of PCM for the benefit of our customers, certified professionals, partners, and the global PCM community.
Privacy Policy

We appreciate your interest in our website https://kcg-pcm.de (hereinafter referred to as the “Website”). We respect your privacy. Therefore, we collect and process your personal data exclusively in accordance with the relevant legal provisions.
This Privacy Policy explains what types of personal data we collect when you use the Website and the services offered and available there (hereinafter referred to as “Services”), and how we process this data.

Personal Data
Personal data refers to any information that can be directly or indirectly associated with you as an individual. This includes, for example, your name, address, phone number, and email address. Non-personal data, on the other hand, refers to general information that cannot be used to identify you. This includes, for example, the number of users of the website.
Collection and Processing of Personal Data
3.1 Web server logs (including IP address)
When you visit the website and/or use the services, our web server automatically collects—for technical reasons—your IP address, the date and time of your visit, the pages you visited, the website you visited previously, the browser you used (e.g., Mozilla Firefox or Google Chrome), the operating system, and the domain name and address of your Internet service provider. To the extent that cookies are used on the website, the web server also stores this information.
We process this information to establish a connection and deliver the website and services to your computer, to monitor and oversee the stability, functionality, and technical performance of the website and services, and to detect, identify, rectify, and resolve any problems or errors.
The legal basis for this is our legitimate interests (Art. 6(1)(f) GDPR), which consist of ensuring the integrity, stability, and functionality of the website and the services—to the extent that this is technically possible and reasonable.
For reasons of technical security, in particular to defend against attempted attacks or other misuse of the website and our system (including our web servers), we may process the information collected by the web server in the event of system misuse in cooperation with your Internet service provider and/or local authorities to identify the perpetrator of such misuse. The legal basis for this is our legitimate interests (Art. 6(1)(f) GDPR), which consist of protecting the integrity of the website, our system, and our users.
3.2 Services on the Website
Furthermore, we collect personal data from you only if you have voluntarily provided it to us in order to use one of the services we offer (e.g., the Certified Professionals section, notifications from Certified Professionals, and inquiries submitted via our contact form). We process this personal data for the purposes specified below in each case.
3.3 General Contact Form
For general inquiries submitted via the contact form, we collect your name, email address, phone number, and the content of your message. If you voluntarily provide additional personal information, we will also collect that personal data. We process this data to handle and respond to your inquiry submitted via the contact form.
The legal basis for this is the performance of pre-contractual measures in response to your inquiry (Art. 6(1)(b) GDPR).
3.4 Inquiry Form for Seminars and Events
When you submit an inquiry via the online form regarding seminars or events offered on the website by PCM-certified trainers, we collect your name, email address, phone number, and the content of your message. This information is forwarded to the trainer you have selected so that they can process your inquiry accordingly. If additional personal data is exchanged in subsequent communication between you and the trainer you have selected, we will not be informed of this. In this case, the privacy policy of the respective trainer applies.
The legal basis for this is the fulfillment of pre-contractual measures in response to your inquiry (Art. 6(1)(b) GDPR).
3.5 Password-Protected Area for Certified Professionals
As part of our Certified Professionals program, we collect (i) certain personal information from you (i.e., your username, name, address, VAT ID number, date of birth, gender, email address, website address, and phone number), (ii) your qualifications (i.e., your specific professional skills and areas of expertise, and your certification status as a Master Trainer, Senior Trainer, Trainer, or Coach), as well as (iii) your website address and the phone number at which your clients can reach you.
We process the aforementioned master data and qualifications in order to carry out our collaboration with you as a Certified Professional.
The legal basis for this is the fulfillment of our contractual obligations (Art. 6(1)(b) GDPR).
Furthermore, we process your website address and the phone number at which you can be reached by clients in order to make this information available on the website under the “Trainer Search” section. If you do not wish this, you can disable this feature at any time using the corresponding settings in the login area.
The legal basis for this is our legitimate interests (Art. 6(1)(f) GDPR). These consist of providing website visitors with optimal information about Certified Professionals, which serves both our and your commercial interests.
3.6 Notifications to Users of the Password-Protected Area
We also collect and process your name, address, gender, and contact information (phone numbers, email addresses) in order to provide you with the following information:
- Innovations in the pedagogy of teaching PCM (particularly exercises, seminar designs, etc.),
- Information about new PCM products or changes to products, marketing materials, and their use, as well as research findings,
- Information about key legal frameworks for working with the PCM,
- the latest news (seminars, technical articles, new members of the community, etc.) from the international PCM community,
- Case studies and articles on process communication and related topics,
- Information about continuing education programs and national and international conferences on PCM, as well as
- Information about your existing contractual relationship with us.
The legal basis for this is the fulfillment of our contractual obligations (Art. 6(1)(b) of the GDPR).
4. Data Transmission and Security
We take appropriate measures to secure your personal data. For security reasons and to protect the transmission of confidential information—such as inquiries you send to us—the website uses SSL or TLS encryption. You can recognize an encrypted connection by the “https://” in your browser’s address bar and by the padlock icon in your browser’s address bar.
Our security measures are subject to a continuous process of improvement and optimization. Please always use the latest version of your web browser to ensure that your personal data is protected as effectively as possible.
Disclosure of Personal Information
5.1 No Disclosure to Third Parties
We do not disclose your personal data to third parties unless it is necessary to fulfill your request, permitted under applicable legal provisions, or you have given us your consent.
5.2 External Service Providers
We are authorized to outsource the processing of personal data, in whole or in part, to external service providers who act on our behalf as data processors (Art. 4(8) GDPR), in accordance with data protection regulations. We strive to work exclusively with service providers located within the European Union. If this is not possible and service providers are based outside the European Union or outside the European Economic Area (EEA) Agreement, we will implement appropriate security measures in accordance with legal and regulatory requirements to ensure the security of your personal data.

6. Retention Period
We will store your personal data only for as long as is necessary to achieve the purposes for which it was collected or—if longer statutory retention periods apply—for the duration specified by law. After that, your personal data will be deleted.
Examples of retention periods: Contact inquiries are deleted once the matter is resolved, or after 3 years at the latest. Contract-related data from Certified Professionals is stored for the duration of the contractual relationship and beyond that for the duration of any statutory retention periods (up to 10 years).

7.1 Technically Necessary Cookies
We use technically necessary cookies to provide the website’s basic functions. These include, in particular, verifying your login in the Certified Professionals area and in your customer account (WooCommerce), securely transmitting your login information, recognizing an active session, and temporarily storing your shopping cart or order during the booking or purchase process. Depending on the cookie, this involves collecting, among other things, your username, an encrypted authentication value, and a session ID.
Consent is not required for technically necessary cookies pursuant to Section 25(2)(2) of the TDDDG (Telecommunications and Digital Services Data Protection Act).
The legal basis for the associated processing of personal data is Article 6(1)(b) of the GDPR (performance of a contract or pre-contractual measures) and, supplementarily, Article 6(1)(f) of the GDPR (our legitimate interest in a functional and fail-safe website).
7.2 Categories of Cookies Used
The cookies used on our website can be divided into two categories:
- Strictly necessary cookies (Section 25(2)(2) of the TDDDG) that are essential for the operation of the website and the provision of our services—for example, for login, customer accounts, and shopping carts. Your consent is not required by law for these cookies.
- Third-party cookies and technologies requiring consent (Section 25(1) of the TDDDG), which are loaded only after you have actively given your consent in the cookie consent banner. This currently includes, in particular, the embedding of YouTube videos (see Section 7.3).

7.3 YouTube
We embed videos from YouTube on our website. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; for users outside the European Economic Area, the provider is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter collectively “Google”).
The videos are embedded in what is known as “enhanced privacy mode” (domain youtube-nocookie.com). According to YouTube, in this mode, information about website visitors is only transmitted to Google once you actively start a video. We have no control over this data transmission.
As soon as you play an embedded YouTube video, your browser establishes a connection to Google’s servers. In the process, your IP address and the page you are viewing, among other things, are transmitted to Google. If you are logged into your YouTube account, you allow YouTube to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account before playing the video.
Since Google also processes content on servers in the United States, the use of YouTube content may result in the transfer of personal data to the United States. Google LLC is certified under the EU-US Data Privacy Framework (available at https://www.dataprivacyframework.gov). In its decision of July 10, 2023, the European Commission determined that companies certified under this framework provide an adequate level of data protection. Regardless, there is a risk that U.S. authorities may be able to access your data.
The legal basis for the integration of YouTube and the associated data transfer is your consent pursuant to Art. 6(1)(a) of the GDPR in conjunction with § 25(1) of the TDDDG, as well as—for transfers to the U.S.—Art. 49(1)(a) of the GDPR. You can revoke your consent at any time with future effect in our cookie settings.

7.4 Cookie Settings and Consent Management
The first time you visit our website, we’ll inform you about the cookies and similar technologies we use via a cookie consent banner and obtain your consent for all cookies that aren’t technically necessary. In the cookie settings, you can at any time:

- enable or disable individual categories at a later time, and
- Revoke your consent in its entirety, effective for the future.
You can find the “Cookie Settings” link permanently in the footer of our website. The legal basis for the use of the consent management tool is Section 25(2)(2) of the German Telemedia Act (TDDDG) in conjunction with Article 6(1)(c) of the GDPR (fulfillment of our legal obligation to provide evidence of consent granted pursuant to Article 7(1) of the GDPR).

Right of Access (Art. 15 GDPR):

When we process your personal data, we take appropriate measures to ensure that your personal data is accurate and up-to-date for the purposes for which it was collected. If your personal data is inaccurate or incomplete, you may request that it be corrected.
Right to Erasure and Restriction (Art. 17, 18 GDPR):
You may have the right to request the erasure or restriction of the processing of your personal data if, for example, there is no longer a legitimate business purpose for such processing in accordance with this Privacy Policy or applicable law, and statutory retention requirements do not preclude erasure.
Right to Data Portability (Art. 20 GDPR):
You may have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used, and machine-readable format, or to transmit this data to another controller.
Right to Object (Art. 21 GDPR):
You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data that is carried out on the basis of Art. 6(1)(f) GDPR (legitimate interests). We will then no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms.
Right to Withdraw Consent (Art. 7(3) GDPR):
If you have consented to the collection and processing of your personal data, you may withdraw your consent at any time with effect for the future; however, this will not affect the lawfulness of the processing carried out on the basis of your consent prior to its withdrawal. In addition, you may object to the use of your personal data for the purposes of market and opinion research as well as advertising.
Right to File a Complaint with a Supervisory Authority (Art. 77 GDPR):
You have the right to file a complaint with a data protection supervisory authority.
